Terms of Service

These Terms of Service (“Terms”) govern your use of the FOMO Events (formerly FOMO Rewards and IVEA Rewards) mobile app, events, social features and loyalty program (the “Service”), operated by IVEA Inter LLC (“FOMO Events,” “we,” “us”). By using the Service you agree to these Terms.

1. Acceptance of these Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service and able to form a binding contract. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

3. Your account & phone verification

You create an account using your mobile phone number, which we verify by sending a one-time code by SMS. You are responsible for the accuracy of your information, for keeping access to your number and device secure, and for activity under your account. Provide a number you own and are authorized to use. 4. The rewards program

  • You earn points on qualifying purchases and visits at participating brands and locations. Eligibility and earning rates may vary and can change.
  • Points have no cash value, are not property, cannot be purchased, sold, or transferred, and are not redeemable for cash except where required by law.
  • Rewards, point values, redemption options, and participating locations may change, and points may expire, at our discretion and with notice where required.
  • One account per person. We may adjust, suspend, or void points or rewards obtained through error, fraud, or violation of these Terms.

5. Purchases, subscriptions & refunds

You can buy three things in the app: digital gift cards, tickets to our in-person events, and a FOMO Plus membership. Payments are processed by Stripe. Your card details go directly to Stripe and we never receive or store them.

  • FOMO Plus. $5.00 per month. It renews automatically each month until you cancel, and your payment method is charged at the start of each billing period. You can cancel any time from the Plus screen in the app; you keep your benefits through the end of the period you have already paid for, and the app shows you that exact last day. We do not give partial refunds for the current month. If we change the price we will tell you first.
  • Gift cards. Spendable at participating restaurants. They do not expire, are not redeemable for cash except where the law requires it, and are not reloadable. A gift card you send to someone else belongs to them once delivered, and stays valid even if you later close your account.
  • Event tickets. Admit you to the event stated on the ticket. Unless the listing says otherwise, tickets are non-refundable, but they are transferable within the app. If we cancel an event, you get a full refund.

Prices are in US dollars and include applicable tax where required. For a refund or a problem with an order, contact us at info@fomorewards.co and we will put it right. Nothing here limits any refund right you have under consumer law.

Because everything sold here is redeemed at our physical restaurants and in-person events, these purchases are handled outside of Apple in-app purchase.

Event reservations and shared plans

Event listings show the available admission options and any eligibility, sale-window or capacity requirements. Free admission requires a confirmed free reservation where tickets are offered; it does not involve a card charge. You can cancel your own free reservation in the app while all tickets in that reservation remain unused. This free-reservation cancellation does not change the paid-ticket refund terms above.

Saving an event or creating, accepting or responding to a shared plan does not reserve admission, buy a ticket or pay for another person. Arrange any required tickets separately. Shared plans let a host invite accepted friends and share meeting details. The host and invited members can see plan details and participant responses, subject to blocking and account access controls. Canceling a shared plan does not cancel event tickets.

Member promotions

Member offers describe a benefit, participating venue or brand, validity period, eligible membership and terms. Some require an active FOMO Plus membership. Present the offer in the app before ordering and follow its displayed terms; any purchase is paid directly to the venue. Showing or saving an offer does not spend points, create stored value or record a purchase. Sharing an offer sends its details to a friend in chat and does not transfer your membership or eligibility. Each person must meet the offer’s own requirements.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful or fraudulent purpose.
  • Attempt to gain unauthorized access to the Service or other accounts, or interfere with its operation.
  • Misrepresent your identity or use a phone number you are not authorized to use.

Photos and captions you post are checked automatically before they appear, and we remove content that breaks these rules. Every post and every chat has a Report option, and you can block any member — blocking hides their content from you and stops them contacting you. We review reports and act on them, which can include removing content and terminating the account responsible. There is no tolerance for objectionable content or abusive behaviour.

Event ratings and optional reviews are visible to other signed-in members with the author name shown in the app. You can edit or delete your own rating. A rating does not by itself verify ticket ownership or event attendance. Reviews, plan notes and offer messages are subject to the same community rules; reported reviews may be hidden by our moderation team. You can report a review or block its author in the app.

Location sharing is optional and limited to accepted friends you select for a one-hour session. Updates occur while the app is in the foreground. A last shared position may remain visible until the session expires or you successfully stop sharing. See our Privacy Policy for these controls.

Contact invitations are optional personal messages. You can choose at least two recipients to review in the invitation flow, but each message is sent separately only after you confirm it in your messaging app. You may enter recipients manually or leave without sending. Choose people you intend to contact and do not use invitations for spam or harassment. FOMO does not upload your contacts or automatically send these messages; your provider’s message and data rates may apply. Sharing an invitation does not guarantee delivery, a signup or referral credit.

7. Intellectual property

The Service, including its content, branding, and the FOMO and FOMO Rewards names and marks, is owned by IVEA Inter LLC or its licensors and is protected by law. These Terms grant you a limited, personal, non-transferable license to use the Service for its intended purpose.

8. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Unused points may be forfeited on termination.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered.

10. Limitation of liability

To the fullest extent permitted by law, IVEA Inter LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).

11. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Maryland for any dispute not subject to arbitration or small-claims resolution.
